1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between Kommify Technologies Pvt. Ltd. (“Kommify”) and the business entity or individual (“Customer”, “you”) accessing or using the Kommify platform, APIs, portals, and communication services. By registering for an account or using our platform, you agree to comply with and be bound by these Terms.
2. Service Description & Platform Capabilities
Kommify provides a multi-channel cloud communication, conversational AI, and business automation platform comprising WhatsApp Business API connectivity, SMS dispatch, RCS for Business, Voice and Cloud IVR services, AI Voice Agents, CRM modules, and developer APIs.
3. Acceptable Use & Compliance Policy
Customer agrees not to use the services for:
- Sending unsolicited commercial communications (spam) or violating TRAI/DLT regulations.
- Transmitting unlawful, abusive, fraudulent, harassing, or defamatory materials.
- Violating Meta’s WhatsApp Business Platform Policy or Google RCS messaging guidelines.
- Attempting unauthorized access, reverse engineering, or disruption of platform infrastructure.
4. Fees, Billing & Third-Party Charges
Kommify platform subscription fees, software licenses, and usage-based consumption charges are billed in accordance with the executed Service Order or selected subscription plan. Customer acknowledges that third-party messaging charges (such as Meta WhatsApp conversation charges and telecom DLT fees) are separate and subject to the respective provider’s rate cards and policies.
5. Service Availability & Support
Kommify employs enterprise-grade infrastructure with multi-cloud redundancy and telecom failover. We provide commercial customer support according to the service level associated with your plan.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Kommify shall not be liable for any indirect, incidental, special, or consequential damages resulting from platform use, upstream carrier outages, or Meta account actions subject to third-party policies.
7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
